Enthusiastic Consent Laws
A bill which would have redefined consent as an enthusiastic ‘yes means yes’ is expected to soon be voted down by the ACT Legislative Assembly, with concerns over that such a new definition would undermine the ‘honest mistake’ defence.
The bill has raised important questions on how we define consent, and upon whom should the burden of proof be placed – questions which lawmakers across Australia are still trying to find the right answer to.
